TERMS & CONDITIONS

These Terms & Conditions govern the use of the ClickCinematics website and the provision of photography, videography and related creative services.

By making an enquiry, confirming a booking, making a payment or engaging ClickCinematics for a project, the client acknowledges and agrees to these Terms & Conditions together with any quotation, proposal, package details or written agreement applicable to the specific project.

Where a specific written agreement or quotation contains terms that differ from these general Terms & Conditions, the specific written agreement will prevail for that project, to the extent permitted by applicable law.



1. About Our Services

ClickCinematics provides photography, videography and related creative services, including services for:

  • Weddings & Celebrations
  • Portraits & Models
  • Corporate Photography
  • Commercial & Brand Photography
  • Event Photography
  • Videography
  • Other creative projects agreed upon with the client

The exact scope of each project depends on the package, quotation or agreement confirmed with the client.


2. Enquiries Are Not Confirmed Bookings

Submitting an enquiry through our website, WhatsApp, email or phone does not automatically confirm a booking.

A booking is confirmed only after:

  • The project requirements have been discussed
  • Availability has been confirmed
  • Pricing and deliverables have been agreed
  • The required advance/payment has been received
  • Any other required booking conditions have been completed

Until confirmation, ClickCinematics may receive enquiries for the same date from other clients.


3. Client Information & Communication

Clients are responsible for providing accurate information, including:

  • Name
  • Contact number
  • Email address
  • Event/project date
  • Location or venue
  • Service requirements
  • Schedule
  • Other information relevant to the project

Clients must also remain reasonably reachable during the planning and execution of a confirmed project.

Unresponsive Clients

If a client becomes unreachable and does not respond to two reasonable communication attempts, ClickCinematics may consider the enquiry or project communication inactive.

Where a booking has not yet been confirmed, ClickCinematics may release any tentative availability.

Where a booking has already been confirmed, failure to respond may affect planning, scheduling or delivery where necessary information or approvals are required from the client.

ClickCinematics will not be responsible for delays, missed updates or consequences arising directly from the client’s failure to provide required information or remain reasonably reachable.


4. Pricing and Quotations

Prices depend on the requirements of each project.

Factors may include:

  • Type of service
  • Duration
  • Number of people
  • Number of locations
  • Travel requirements
  • Deliverables
  • Equipment requirements
  • Production requirements
  • Editing requirements
  • Additional services

A quotation or proposal may have a specified validity period.

Prices or availability may change before a booking is confirmed.


5. Advance Payment

A booking may require an advance payment as communicated in the quotation or booking confirmation.

Payment of the required advance confirms the client’s acceptance of the applicable booking terms and reserves the agreed date/services, subject to the agreed conditions.

Once an advance has been paid for a confirmed booking, the advance is non-refundable, subject to applicable law and any specific written terms agreed for that booking.


6. Cancellation by the Client

If a client cancels a confirmed project or event after paying the advance:

The advance payment will not be refundable, subject to applicable law and the specific written agreement governing the booking.

This is because the date, resources, planning time and availability may have been committed to the project.

Any additional cancellation terms communicated in the specific quotation or booking agreement will also apply.


7. Postponement or Rescheduling

If an event or project is postponed or the client requests a change of date:

  • The original advance remains non-refundable, subject to applicable law and the applicable booking agreement.
  • The new date is subject to ClickCinematics’ availability.
  • A new date is not guaranteed until confirmed by ClickCinematics.
  • Additional costs may apply if the new date creates additional travel, staffing, equipment, accommodation, production or other expenses.
  • If ClickCinematics is unavailable for the requested new date, the original advance will remain subject to the cancellation terms applicable to the booking.

Clients should communicate any proposed date changes as early as possible.


8. Changes to Event Schedule

Clients are responsible for providing accurate schedules and informing ClickCinematics of material changes as early as reasonably possible.

Changes to timings, locations, event schedules, shooting requirements or deliverables may affect the scope, availability and cost of the project.

Additional charges may apply where changes require additional shooting hours, travel, equipment, personnel or production resources.


9. Client Responsibilities

Clients are responsible for:

  • Providing accurate project information
  • Providing access to agreed locations
  • Informing us about important restrictions or requirements
  • Obtaining necessary venue permissions where applicable
  • Informing relevant participants about photography/videography
  • Providing required approvals
  • Providing timely feedback where required
  • Ensuring a suitable environment for the agreed work

10. Venue Access & Permissions

The client is responsible for obtaining permissions required for photography or videography at venues, private properties or other restricted locations unless otherwise agreed in writing.

If ClickCinematics is prevented from working because the required permission or access has not been obtained, we will not be responsible for missed photographs, footage or deliverables resulting from that restriction.


11. Equipment, Property Damage & Loss

ClickCinematics may use professional cameras, lenses, lighting equipment, audio equipment, computers, storage devices, stands, tripods and other production equipment during a project.

The client is responsible for damage to or loss of ClickCinematics’ equipment or property where such damage or loss is caused by the client or by persons under the client’s responsibility or control, including guests, attendees, representatives, staff, vendors or other persons associated with the client’s event, to the extent permitted by applicable law.

This includes damage caused by:

  • Mishandling
  • Unauthorised use
  • Physical impact
  • Spillage or liquid damage
  • Intentional damage
  • Negligent or careless conduct
  • Moving or interfering with equipment without permission
  • Other avoidable damage caused during the project

Where equipment is damaged beyond repair or lost, the client may be responsible for the reasonable repair or replacement cost, as applicable.

Where equipment can be repaired, the client may be responsible for the reasonable repair cost.

ClickCinematics will not charge the client for ordinary wear and tear or damage caused solely by ClickCinematics’ own normal use of equipment.


12. Client Property

Clients are responsible for their own personal belongings, products, props, costumes, accessories, devices and other property brought to a shoot or event.

ClickCinematics is not responsible for loss or damage to client property except where liability cannot lawfully be excluded.


13. Photography & Videography Style

Clients are encouraged to review ClickCinematics’ portfolio before booking.

Photography and videography involve creative judgement, including:

  • Composition
  • Lighting
  • Framing
  • Colour
  • Editing
  • Selection of photographs
  • Video pacing
  • Music selection where applicable
  • Creative direction

The final work may not reproduce another photographer’s or filmmaker’s style exactly unless specifically agreed.


14. Deliverables

The deliverables provided will be those specifically agreed in the quotation, package or project agreement.

Unless specifically included, the following may not form part of the standard deliverables:

  • RAW photographs
  • Unedited video footage
  • Project files
  • Editing timelines
  • Unused photographs
  • Unused footage
  • Additional revisions
  • Additional shooting hours
  • Additional locations
  • Additional deliverables

Any additional deliverables may be subject to additional charges.


15. Selection & Editing

ClickCinematics may select photographs and footage based on technical quality, composition, storytelling and the agreed creative approach.

Images or footage that are technically unsuitable, duplicated, accidental, test shots, severely obstructed or otherwise unsuitable for final delivery may not be included.

Editing will follow the agreed creative style and scope.

Additional editing or extensive revisions outside the agreed scope may incur additional charges.


16. Delivery Timelines

Estimated delivery timelines may vary depending on:

  • Type of project
  • Volume of photographs or footage
  • Editing requirements
  • Number of projects being processed
  • Client feedback or approvals
  • Third-party requirements
  • Unforeseen circumstances

ClickCinematics will make reasonable efforts to meet communicated delivery timelines.

Where a specific delivery date is contractually agreed, that specific agreement will apply.


17. Client Delays

Where client approvals, information, selections, feedback, access or other required inputs are delayed, the delivery timeline may also be extended accordingly.

ClickCinematics will not be responsible for delays caused directly by the client or circumstances outside our reasonable control.


18. Project Data Retention

ClickCinematics will retain project photographs, videos, footage and related project data for 6 months from the date of final delivery, unless a different period has been agreed in writing.

After the 6-month retention period, ClickCinematics may permanently delete the project files.

Client Responsibility

Once deliverables have been delivered, the client is responsible for:

  • Downloading the files
  • Collecting the delivered material
  • Maintaining backups
  • Keeping the files securely stored

Clients should not rely on ClickCinematics as their permanent storage provider.

After the 6-month retention period, ClickCinematics will not be responsible for the availability, recovery or restoration of deleted project files.


19. Copyright & Use of Creative Work

Photography and video are protected creative works under applicable copyright law. Indian copyright law recognises photographs as artistic works and identifies the photographer as the author, while ownership can depend on the circumstances and agreements surrounding commissioned work.

Unless otherwise agreed in writing, ClickCinematics retains the rights applicable to the creative work and grants the client the agreed right to use the final delivered work for the purposes communicated at the time of booking.

Clients may not commercially resell, license, reproduce or substantially modify ClickCinematics’ work beyond the agreed usage without appropriate permission.

Where a specific written agreement provides different copyright or usage terms, that agreement will apply.


20. Portfolio & Promotional Use

Unless otherwise agreed in writing, ClickCinematics may use selected photographs and videos created during a project for:

  • Website portfolio
  • Social media
  • Marketing
  • Advertising
  • Promotional material
  • Showreels
  • Business presentations

If a client requires the project to remain private or confidential, this should be discussed and agreed before the project is confirmed.


21. Client-Provided Materials

If a client provides photographs, videos, music, logos, designs, documents or other material for use in a project, the client confirms that they have the necessary rights or permissions to provide and use those materials.

The client is responsible for claims arising from unauthorised materials supplied by the client.


22. Third-Party Materials

Where a project requires third-party music, stock footage, fonts, locations, talent, licences or other third-party resources, additional costs or usage restrictions may apply.

The client may be responsible for such costs where they fall outside the agreed project scope.


23. Events Beyond Our Reasonable Control

ClickCinematics will not be responsible for failure or delay caused by circumstances beyond our reasonable control, including:

  • Natural disasters
  • Severe weather
  • Government restrictions
  • Public emergencies
  • Accidents
  • Serious illness or injury
  • Venue closure
  • Transport disruption
  • Fire
  • Technical infrastructure failure
  • Power failure
  • Civil disturbance
  • Other unforeseen circumstances

Where reasonably possible, ClickCinematics will communicate with the client and attempt to find an appropriate solution.


24. Technical Failure & Backup

ClickCinematics takes reasonable precautions to protect photographs and footage, including appropriate production and storage practices.

However, photography and videography involve technical equipment and digital storage systems, and unforeseen technical failures can occur.

We will make reasonable efforts to prevent loss and recover usable material where possible.

Nothing in these Terms & Conditions excludes liability that cannot legally be excluded.


25. Client Conduct

Clients and event attendees are expected to treat ClickCinematics personnel respectfully and provide a reasonably safe working environment.

ClickCinematics may stop or suspend work where there is serious harassment, abuse, threatening behaviour, unsafe working conditions or unlawful conduct.

Where work is stopped because of client or attendee conduct, the applicable booking and payment terms will remain subject to the specific circumstances and applicable law.


26. Safety

ClickCinematics may decline to perform a requested shot, activity or setup where we reasonably believe it presents a significant risk of injury to our team, the client, guests or equipment.

Client requests do not require ClickCinematics to undertake unsafe activities.


27. Travel & Additional Expenses

Where a project requires travel outside the agreed service area, additional travel, accommodation, transportation, parking, permits or other expenses may apply.

Any applicable costs will be communicated to the client where reasonably possible before they are incurred.


28. Changes to Project Requirements

Any substantial change to the originally agreed scope may result in:

  • Revised pricing
  • Revised deliverables
  • Revised schedule
  • Additional equipment requirements
  • Additional personnel requirements
  • Additional editing or production charges

Changes should be agreed before the additional work is undertaken wherever reasonably possible.


29. Website Content

All photographs, videos, graphics, written content, branding and other creative material displayed on the ClickCinematics website belong to ClickCinematics or are used with appropriate permission unless otherwise stated.

Unauthorised copying, reproduction, commercial use or redistribution is prohibited.


30. Privacy

Personal information submitted to ClickCinematics is handled in accordance with our Privacy Policy.

The Privacy Policy forms part of the overall website terms governing the handling of information.


31. Changes to These Terms

ClickCinematics may update these Terms & Conditions from time to time.

The latest version will be published on this page with the applicable “Last Updated” date.

Changes to general website terms will not automatically alter specific contractual terms already agreed with a client unless permitted by the applicable agreement or law.


32. Governing Law

These Terms & Conditions shall be governed by the laws applicable in India.

Any disputes will be addressed in accordance with applicable Indian law and the jurisdiction of the competent courts/authorities, subject to any mandatory rights or remedies available to the client under applicable law.
